Truck crosses center line and causes fatal crash in Acy
Acy, LA – Driving left of center is a very common cause of accidents. However, these kinds of crashes also often cause head on collisions which can be fatal or cause permanent injuries. If a driver crossed the center line and caused a crash, anyone who they hurt may be able to file a civil lawsuit for compensation to pay for their losses such as medical treatment and lost income.
The Advocate reported on an accident that claimed the life of a 55 year old woman in Acy [1].
Woman is killed while driving around a highway curve
The victim was going eastbound on Louisiana 22 in lower Ascension Parish near the Louisiana 937 intersection. When the victim was going around a curve at approximately 2 pm, a truck that was going eastbound crossed the center line of the road. These two vehicles collided, then another pickup truck that was going eastbound crashed into these two as well. All three drivers involved were wearing their seatbelts, and the two truck drivers were not harmed. However, the victim needed to be transported to the hospital to be treated for her injuries. She later died while being treated.
Police still do not have a reason why the first truck driver went across the center line and caused the collision. They took toxicology samples from everyone involved and they were conducting an investigation. There was no information about whether any drivers will be cited or charged for the accident.
How to determine when a truck driver is negligent
Accident lawsuits are based on the legal concept of negligence. This means that the driver breached the standard of care that is expected of all people on the roads, their actions were the direct cause of the crash, and the plaintiff sustained actual damages. In practice, most negligent drivers were engaged in behaviors such as speeding, drunk driving, texting while driving, or various other traffic violations. In situations where negligence is less clear, it may be possible to divide negligence for all parties involved in the crash under the principles of comparative negligence. A driver who is partially negligent can still collect damages under this system in Louisiana, however their level of compensation is reduced according to their level of fault for the accident.
