Michael L. Dimezza, 53, was stopped at a traffic light around 5:30 a.m. on Socrum Loop Road at the Lakeland Park Boulevard intersection when a Polk County Waste and Recycling truck hit his 2009 Harley Davidson motorcycle from behind. Dimezza was ejected from the bike and wasn’t wearing a helmet. Unfortunately, he was pronounced dead at the scene of the accident. Socrum Loop was closed for nearly 4 ½ hours after the accident in order for an investigation to be conducted.

Although the Lakeland Police Traffic Homicide Unit is still in the process of investigating the truck accident, no charges have been filed as of yet. The Ledger has reported that the garbage truck driver, Lamar, isn’t employed with the county, rather, he works for a private contractor. That private contractor is British-based FCC Environmental Services. The company is responsible for handling trash and recycling pickups in West Polk. Aside from the investigation being conducted by the Lakeland Police Traffic Homicide Unit, the FCC is also doing an internal investigation and have since stated that once they have something to share regarding the accident, they will.

When can a family file a lawsuit on behalf of their loved one who is injured or killed in an accident?

When a person survives an accident but sustains an injury, they may be entitled to file what is called a personal injury lawsuit if the person or entity that contributed to the accident displayed negligence. Because they survived the collision, they would be able to take legal action on their own, unless they are a minor. But, if someone is killed in a truck collision that was brought on by negligent or reckless actions, then the surviving family may be entitled to file a wrongful death lawsuit. Some things you want to keep in mind when attempting to pursue either type of lawsuit is:

  1. You will want to hire a truck accident lawyer in Lakeland, FL to assist with the process. The reason you will want a legal representative helping you is that they will be able to identify the responsible parties to go after. In the case mentioned above, the family may be able to sue the truck driver as well as the company but won’t know for sure until a lawyer reviews the details of the accident.
  2. These cases can take time so you will want to be patient as your truck accident attorney works diligently to obtain a settlement or verdict if you are pressing charges.

If you were recently injured in an accident involving a big rig or semi-truck, consider hiring a truck crash attorney so they can help you recover compensation for the damages caused.

  3. If you haven’t yet hired a lawyer, consider contacting Smith Feddeler & Smith, P.A. at 1-800-200-7546.
